These terms and conditions ("Agreement")
are between the employer or the company listing the job vacancy and/or
opportunity ("Employer(s)") and PhDHive ("Job Search
Website") for the use of the Job Search Website and related services.
By posting a job listing, the Employer agrees to be bound by the
following terms and conditions:
1. Definitions:
a. "Employer" refers to the entity posting a job listing and seeking to fill a vacancy.
b. "Candidate" refers to a job seeker, a Ph.D. holder, registered with the Job Search Website looking for job opportunities in the industry.
c. "Services" refer to the job search platform and associated tools
provided by the Job Search Website.
2. Job Listing:
a. The Employer is responsible for providing accurate, complete, and up-to-date information when submitting a job listing. The Employer must clearly outline the job requirements, qualifications, location, and any additional expectations.
b. The Job Search Website reserves the right to edit, modify, or remove any job listing that is in violation of this Agreement or applicable laws.
c. The Employer acknowledges and agrees that the Job Search Website does not guarantee that a specific number of candidates will apply for the job listing or that the candidates will meet the Employer's requirements.
d. The Employer is responsible for ensuring that the job listing
complies with applicable laws, including anti-discrimination laws.
3. Payment:
a. The Employer must
pay all applicable fees for the Services as outlined by the Job Search Website.
b. The Job Search Website reserves the right to revise its fees for the
Services by providing notice to the Employer.
4. Relationship between the Parties:
a. The Job Search
Website serves as a platform to connect Employers with Candidates, and nothing
in this Agreement implies an employment, agency, partnership, or joint venture
relationship between the Employer, Candidate, and Job Search Website.
b. The Employer is solely responsible for the hiring, screening, and selection
of a Candidate. The Job Search Website does not endorse or guarantee the
qualifications, abilities, or performance of any Candidate.
5. Confidentiality and Privacy:
a. The Employer
shall maintain the confidentiality of all information received from or about
Candidates, including personal information, resumes, and contact information.
b. The Employer shall comply with all applicable privacy laws, including the
General Data Protection Regulation (GDPR), and shall only use the Candidate's
personal information for the purposes of considering them for the job listing
without any unauthorized disclosure or misuse.
6. Intellectual Property:
a. The Job Search Website owns all intellectual property rights in and to the
Services, including their design, layout, content, and technology.
b. The Employer grants the Job Search Website a non-exclusive, worldwide,
royalty-free license to use, display, and reproduce its trademarks and logos in
connection with the promotion and operation of the Services.
7. Liability and Indemnification:
a. The Job Search Website shall not be liable for any loss, cost, expense, or
damage resulting from the Employer's use of the Services, including the hiring
or failure to hire a Candidate.
b. The Employer agrees to indemnify, defend, and hold harmless the Job Search
Website, its officers, directors, employees, and agents from any and all
claims, damages, losses, or expenses arising from or relating to the Employer's
breach of this Agreement, violation of applicable laws, or any agreements entered
into with Candidates.
8. Termination:
a. The Employer may terminate this Agreement at any time by ceasing to use the
Services and removing any job listings.
b. The Job Search Website may terminate this Agreement at any time, with or
without cause, by providing written notice to the Employer.
9. Governing Law:
a. This Agreement shall be governed by and construed in accordance with the
laws of United Kingdom, without regard to its conflict of law provisions.
10. Amendments and Modifications:
a. The Job Search Website reserves the right to modify this Agreement at any
time. Any changes to the Agreement will be effective upon the Employer's next
use of the Services.
By ticking the "I Agree" checkbox and posting a job listing, the Employer
acknowledges that they have read, understood, and agreed to be bound by the
terms and conditions set forth in this Agreement.
